ONCF Voyages Privacy Policy

CHAPTER I – PERSONAL DATA AND INTELLECTUAL PROPERTY

1. PERSONAL DATA AND CONFIDENTIALITY

a. Collection and processing of personal data

By making a reservation, the User agrees to provide a certain amount of personal data, which will be processed in accordance with the provisions of law 09-08 promulgated by Dahir No. 1-09-15 of 22 Safar 1430 (18 February 2009) (Article 5 of law 09-08), under authorization No. [A-GC-131/2020] with the National Commission for the Supervision of the Protection of Personal Data.

The User is solely responsible for the data provided to ONCF. This data will be processed by ONCF and its partners, responsible for processing all personal data collected during the User's travel request, in accordance with the following purposes:

  • Management of customer accounts;
  • Management of commercial transactions;
  • Tickets or cards issuing;
  • Commercial prospecting;
  • Satisfaction surveys;
  • Relational program (following the purchase of a card);
  • Customer relationship management.
  • Launching advertising campaigns through various forms of electronic messaging (SMS, email, etc.).
  • Improving services.
  • Management of statistics on the use of the oncf-voyages.ma website (most visited pages, site access frequency, etc.).

ONCF, along with its partners, commits to using this data only when necessary for the proper execution of the journey.

b. Right of access, rectification and deletion of personal data

In accordance with applicable legislation on the protection of personal data, Users may exercise their right to access, rectify and delete their personal data.

The User may exercise all these rights by sending:

  • An e-mail to the following address: DPO@oncf.ma.
  • A letter by post to the following address: DPO, Direction Juridique et Contrôle, Office National des Chemins de Fer, 8 Bis, Rue Abderrahmane El Ghafiki, Agdal, Rabat.

This data will be used by ONCF both to send e-tickets, access control and control on board trains, and to send promotions and new offers, if the User so wishes, and may be communicated to any administrative or judicial authority with a right of communication.

The User has an individual right of access at all times, as well as a right to additional information, rectification of data concerning him or her, and, where applicable, opposition to the processing or transmission of such data.

To exercise these rights, simply send an e-mail to the following address DPO@oncf.ma.

2. CMI PAYMENT PLATFORM

The CMI system guarantees the confidentiality of banking data entered by customers on its payment platform. This data is transmitted from the customer's browser to the CMI platform using encryption techniques (SSL, HTTPS protocols) to ensure the confidentiality of transaction content. These techniques prevent personal data (identity, address, card number, etc.) from being recovered by a malicious third party.

The customer's bank details are transmitted directly to the Centre Monétique Interbancaire ("CMI"). The CMI handles financial transactions between the customer's bank and the merchant's bank over a closed, non-open Internet banking network.

This guarantee is based on national and international procedures and regulations with which CMI complies, and relies on technologies and concepts recognized and approved by all the world's e-commerce players.

3. INTELLECTUAL PROPERTY

a. General

The User shall refrain from infringing ONCF's intellectual property rights (copyright, neighbouring rights, trademark rights, domain names, etc.) (texts, logos, images, sound elements, software, icons, layout, database) without limitation.

The elements accessible on the Site, notably in the form of texts, photographs, images, icons, maps, sounds, videos, software, databases and data, are also protected by intellectual and industrial property rights and other private rights held by ONCF.

Failure to comply with these prohibitions may result in civil and/or criminal liability on the part of the User.

For the "Oncf-voyages.ma" site and ONCF Voyages app, ONCF declares that it holds all intellectual property rights and related usage rights.

Access to the Site or to the App does not confer any right to the intellectual property rights relating to the Site, which remain the exclusive property of ONCF.

Except as provided in these General Conditions, the User may not, under any circumstances, reproduce, represent, modify, transmit, publish, adapt, in any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Site without the prior written consent of ONCF.

The insertion of hypertext links to any part of the Site or the App is prohibited without the prior written authorization of ONCF.

b. Software

The use of any software downloaded from the Site or the App to access certain services is governed by the terms of the accompanying license. The User undertakes not to install, copy or use such software without first agreeing to the terms of said license.

In the case of any software not accompanied by a license, the User is granted a temporary, private, personal, non-transferable and non-exclusive right to use the software for the sole purpose of accessing the services that require use of the software. By installing or using the software, the User undertakes to comply with this condition.

4. COOKIES

As part of the improvement of its services, cookies may be placed on the user's computer, phone or tablet in order to generate statistics on the use of the oncf-voyages.ma site or the ONCF Voyages app (most visited pages, frequency of access to the site, etc.).

The statistics generated using these cookies are kept for a period of two years.

CHAPTER II – LIABILITIES AND WARRANTIES

1. For use of the Site

ONCF does not guarantee that the Site or the App will be free of anomalies, errors or bugs, or that these can be corrected, or that the Site or the App will function without interruption or breakdown, or that they are compatible with any particular hardware or configuration other than those expressly mentioned by the Oncf-voyages.ma site or the ONCF Voyages app.

ONCF is in no way responsible for malfunctions attributable to third-party software.

Under no circumstances will ONCF be liable for any type of foreseeable or unforeseeable damage, material or immaterial (including loss of profits or opportunity...) arising from the use or total or partial inability to use the Site or the App.

The User acknowledges that he/she has checked that the computer configuration he/she is using is virus-free and in perfect working order.

2. Acceptance of Internet risks

The User declares that he/she is aware of the risks associated with the Internet and acknowledges that:

  • Data exchanges on the Internet are relatively reliable and are therefore not protected, in particular against the risks of misappropriation and piracy;
  • The technical performance of the Internet network, as well as response times for consulting, querying or transferring data, are variable and random.

Unless the Site or the App malfunctions for which it is responsible, ONCF may not be held liable for any anomalies that may occur during Ordering, processing or printing of the electronic ticket, attributable either to the User's fault, or to the unforeseeable and insurmountable fault of a third party outside the service, or to a case of force majeure (for example, anomalies caused by any hardware, software or means of connection used or by a third-party service provider).

3. Other websites

Some third-party websites use ONCF's own data, over which ONCF has no influence. ONCF therefore accepts no responsibility for the completeness, comprehensiveness and legality of the content of these sites and the links to other sites contained therein, or for any products, offers and services presented therein. The same applies when these sites contain the ONCF logo or another protected designation. Use of these websites is at the User's own risk.
